These Terms of Service govern your use of hemsley.us and any purchase you make through it. The site is operated by Hemsley Herrick LLC, a Massachusetts limited liability company located at 5 Briscoe St., Unit 2, Beverly, MA. Throughout these terms, "we," "us," and "our" refer to Hemsley Herrick LLC, and "you" refers to you as a visitor or customer.
By browsing this site or placing an order, you agree to these terms. If you do not agree with them, please do not use the site.
1. Eligibility
You must be at least 13 years old to use this site. If you are under 18, you may only use the site and place orders with the involvement and consent of a parent or legal guardian, who agrees to be responsible for your activity and for any purchase made. We do not knowingly permit anyone under 13 to use the site or provide us with personal information.
2. One-of-one work
Nearly everything sold here is a unique, hand-painted piece. Each item is made once and is not reproduced, restocked, or reissued. Because pieces are painted by hand on canvas, apparel, footwear, bags, and other sourced goods, the following are expected and are not defects:
- Variation in color, texture, brush and pen work, and coverage between the photographs and the piece you receive
- Variation in sizing, fit, and measurement, including between items labeled with the same size
- Visible signs of the base item's prior life, including wear, creasing, patina, and minor marks on sourced or vintage goods
- Natural aging, cracking, or softening of paint on worn items over time
We photograph pieces as accurately as we can. Screen calibration differs between devices, so exact color reproduction on your display cannot be guaranteed.
3. Base items and brand names
Some pieces are painted on second-hand or sourced goods originally manufactured by other brands. Where a brand is referenced, it is used solely to describe the base item that was painted. Hemsley Herrick LLC is not affiliated with, endorsed by, sponsored by, or connected to any such brand. The artwork applied to those goods is original and is the sole creative work of Hemsley Herrick. Any trademarks referenced remain the property of their respective owners.
4. Orders, pricing, and availability
All prices are listed in United States dollars. Placing an order is an offer to purchase, not a completed sale. We reserve the right to accept or decline any order, to limit quantities, and to correct pricing or description errors, including after an order has been placed. If we cancel an order after payment, you will receive a full refund to the original payment method.
Because inventory is one-of-one, a piece may sell between the time you add it to your cart and the time you attempt to check out. Adding an item to a cart does not reserve it.
5. Payment
Payments are processed through Shopify, including Shop Pay and the additional payment methods Shopify makes available, such as credit and debit cards, Apple Pay, Google Pay, and PayPal where offered. We do not collect or store full payment card numbers on our own systems. Your payment information is handled by the applicable payment processor under its own terms and privacy policy.
6. All sales are final
Every sale is final. We do not accept returns, exchanges, or cancellations, and we do not issue refunds for change of mind, fit, sizing, or the ordinary variation described in Section 2. This policy exists because each piece is unique and cannot be restocked or resold as new once it has shipped.
If your order arrives damaged in transit, or if you receive an item other than the one you ordered, contact us at hemsleyherrick@gmail.com within 7 days of delivery with your order number and clear photographs of the item and its packaging. We will review the claim and, at our discretion, arrange a replacement where possible, a repair, or a refund. Because pieces are one-of-one, an identical replacement is usually not available.
We encourage you to ask any question before ordering. Message us and you will get a direct answer about condition, measurements, or materials.
7. Shipping and international orders
We ship worldwide from Massachusetts. Shipping costs and available methods are shown at checkout. Delivery estimates are estimates only and are not guaranteed. Risk of loss passes to you once the carrier takes possession of the package.
For orders shipped outside the United States, you are the importer of record. You are responsible for all customs duties, import taxes, VAT, brokerage charges, and any other fees imposed by the destination country. These are not included in the purchase price or the shipping cost, and they are not refundable by us. If a package is refused, abandoned, or returned to us because import charges went unpaid, we are not obligated to issue a refund.
You are responsible for providing a complete and accurate shipping address. We are not responsible for orders lost due to an incorrect address supplied at checkout. Some destinations may be restricted or unavailable, and we may cancel and refund an order we cannot ship safely.
8. Commissions and custom work
Commissioned and custom pieces, including live painting on an item you provide, are quoted individually. Scope, price, materials, and turnaround are confirmed in writing before work begins, and those written terms govern the commission alongside these terms.
Painting is permanent and cannot be reversed. If you provide your own item, you confirm that you own it and that you accept full responsibility for the outcome, including the risk that painting alters or reduces its value. Commissioned work and painting on customer-supplied items are not eligible for refund once work has begun.
9. Intellectual property
All artwork, designs, drawings, characters, motifs, photographs, text, and other content on this site are the property of Hemsley Herrick LLC and Hemsley Herrick, and are protected by United States and international copyright law.
Purchasing a piece transfers ownership of that physical object only. It does not transfer copyright or grant any license to reproduce the artwork. Without our prior written permission, you may not:
- Reproduce, print, scan, photograph for commercial use, or otherwise copy the artwork
- Create derivative works, prints, apparel, merchandise, or digital assets based on the artwork
- Mint, tokenize, or otherwise register the artwork or any image of it on a blockchain
- Use the artwork or the Hemsley Herrick name, wordmark, or logo for advertising, branding, or commercial promotion
- Use the artwork to train, fine-tune, or otherwise develop any machine learning or artificial intelligence model or dataset
You are welcome to photograph and share a piece you own for personal, non-commercial purposes, and we appreciate a credit when you do. Reselling a piece you own is permitted; representing yourself as its creator, or reproducing it, is not.
10. Your submissions
If you send us photographs, messages, tags, or other content, or if you appear in photographs or video taken at a market, pop-up, or live painting event, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and share that content to promote Hemsley Herrick, including on our website and social media. You can ask us to stop using a specific image by emailing us.
11. Events and live painting
Event dates, locations, and hours are subject to change or cancellation without notice. Where live painting is offered free or on a first-come basis, availability is limited and not guaranteed. Attendance is at your own risk.
12. Acceptable use
You agree not to use the site to break any law, infringe anyone's rights, transmit malicious code, scrape or harvest data, attempt to gain unauthorized access to our systems, or interfere with the operation or security of the site.
13. Third-party links and services
The site may link to or rely on services we do not control, including Shopify, payment processors, shipping carriers, analytics providers, and social media platforms. We are not responsible for the content, policies, or practices of those third parties.
14. Disclaimer of warranties
The site and everything sold through it are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, secure, or error-free.
Hand-painted items are not intended for heavy wear, laundering, or exposure to solvents, heat, or prolonged sunlight. Care instructions are provided as guidance, and we are not liable for damage resulting from wear, cleaning, alteration, or storage after delivery.
15. Limitation of liability
To the fullest extent permitted by law, Hemsley Herrick LLC and Hemsley Herrick will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising from your use of the site or any item purchased. Our total liability for any claim relating to an order will not exceed the amount you paid for that order.
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
16. Indemnity
You agree to indemnify and hold harmless Hemsley Herrick LLC, Hemsley Herrick, and anyone acting on their behalf from any claim, loss, liability, or expense, including reasonable legal fees, arising from your breach of these terms or your misuse of the site or of any artwork.
17. Governing law and disputes
These terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of law rules. Any dispute arising from these terms or from a purchase will be brought exclusively in the state or federal courts located in Essex County, Massachusetts, and you consent to the jurisdiction of those courts.
18. Changes to these terms
We may update these terms at any time. The version posted on this page at the time of your order applies to that order. Continued use of the site after changes are posted means you accept the updated terms.
